Terms of Service
These Terms of Service (the "Terms") govern your access to and use of atlas-itin.com and the ITIN application facilitation service operated by Atlas Compliance Inc, a Florida corporation ("Atlas," "we," "our," or "us"). By placing an order, creating an account, or using the site, you agree to these Terms. Please read them carefully.

Service-Nature Notice (Read Before You Agree)
Important. Atlas Compliance Inc is a private service facilitation company registered in the State of Florida, USA. We are not a Certifying Acceptance Agent (CAA), not a government agency, and not affiliated with, endorsed by, or associated with the Internal Revenue Service (IRS). ITIN applications submitted through our platform are processed, certified, and submitted to the IRS by IRS-authorized Certifying Acceptance Agents through our business partnerships. ITIN approval is determined solely by the IRS — we cannot guarantee approval of any application. An Individual Taxpayer Identification Number (ITIN) is issued by the IRS for federal tax filing purposes only. It does not authorize employment in the United States, does not provide immigration status or legal residency, and does not confer eligibility for Social Security benefits.
1. Definitions
- "Atlas" or "we" means Atlas Compliance Inc, a Florida corporation with its registered address at 2125 Biscayne Boulevard, Ste 204 #24685, Miami, Florida 33137, USA.
- "Service" means the ITIN application facilitation service we provide, including marketing, intake, customer support, document collection, payment processing, hand-off to a CAA partner, and ITIN delivery.
- "Site" means atlas-itin.com and any related subdomains, applications, and portals operated by us.
- "You" or "Customer" means the natural person, 18 years or older, who places an order and accepts these Terms, including a parent or legal guardian submitting an order on behalf of a dependent.
- "CAA Partner" means the IRS-authorized Certifying Acceptance Agent or Acceptance Agent we engage to certify and submit ITIN applications to the IRS.
- "ITIN" means an Individual Taxpayer Identification Number issued by the IRS pursuant to 26 U.S.C. §6109 and IRS Publication 1915.
- "Order" means a paid request you submit to us for facilitation of an ITIN application.
- "IRS Determination" means the IRS's final decision to issue, deny, or further review an ITIN application.
2. Eligibility
- You must be at least 18 years old and have legal capacity to enter into a contract.
- You represent that you (or, in the case of a dependent application, the dependent on whose behalf you are applying) are eligible to apply for an ITIN under IRS rules. Atlas does not make the eligibility determination — the IRS does.
- Parents and legal guardians who are 18 years or older may place an order on behalf of a dependent (spouse or child). The submitting adult is the Customer of record for all purposes of these Terms.

3. Service Description and Party Roles
- Atlas's role. Atlas operates the Site, accepts orders, collects documents and information from you, processes payment, and submits your order package to a CAA Partner. Atlas is a service facilitation company; Atlas is not itself a CAA.
- CAA Partner's role. The CAA Partner is an IRS-authorized entity that reviews, certifies, and submits your ITIN application to the IRS in accordance with IRS Publication 4520 and Form W-7 instructions.
- IRS's role. The IRS receives the certified application and makes the final approval, denial, or further-review determination. Standard IRS processing time is approximately 6 to 12 weeks. Processing times are outside our control.
- Mandatory acknowledgments.
- Atlas Compliance Inc is a private service facilitation company. We are not a Certifying Acceptance Agent (CAA), government agency, or affiliate of the Internal Revenue Service (IRS). ITIN applications are processed by IRS-authorized CAA partners.
- ITIN approval is determined solely by the IRS. We cannot guarantee approval of any application.
- An ITIN is issued for federal tax filing purposes only. It does not authorize employment in the United States, provide immigration status or legal residency, or confer eligibility for Social Security benefits.
- Standard IRS processing time for ITIN applications is approximately 6 to 12 weeks. Processing times are outside our control.
4. Account and Order Model
- The Service operates as a one-time guest checkout. No persistent password-protected account is required. You receive order-status access via the email address you provide together with the order number we assign.
- You are responsible for the accuracy of the email address and contact information you provide. We are not liable for missed updates resulting from inaccurate contact information.
5. Pre-Checkout Acknowledgement
Before completing checkout you must affirmatively accept the following combined acknowledgement by checking the corresponding box:
"I am 18 years of age or older. I have read and agree to the Terms of Service, Disclaimer, Refund and Cancellation Policy, and all associated policies of Atlas Compliance Inc. I understand that Atlas Compliance Inc is a service facilitation company that connects applicants with IRS-authorized Certifying Acceptance Agents (CAAs) for ITIN application processing, and that Atlas Compliance Inc is not itself an IRS Certifying Acceptance Agent, a government agency, or affiliated with the IRS."
This acknowledgement is required to form a contract. Order placement constitutes electronic acceptance of these Terms pursuant to the Electronic Signatures in Global and National Commerce Act, 15 U.S.C. §7001. You consent to receive disclosures from us electronically. You may request a paper copy of any disclosure by emailing hello@atlas-itin.com.
6. Service Tiers, Fees, and Payment
- Tiers. We offer two tiers:
- Standard — $499 USD. Atlas + CAA preparation and submission to the IRS in 7 to 10 business days.
- Priority — $599 USD. Atlas + CAA expedited preparation and submission to the IRS in 1 to 3 business days.
- Tier-timeline disclaimer. The 7–10-business-day Standard timeline and the 1–3-business-day Priority timeline cover Atlas and CAA preparation and submission to the IRS only. They do not include IRS processing. IRS processing takes approximately 6 to 12 weeks after submission and is outside our control.
- Currency. All prices are in U.S. Dollars (USD). This is a one-time payment, not a subscription. There are no automatic renewals.
- Payment processor. Payments are processed by Stripe, Inc., a PCI-DSS Level 1 service provider. We do not store full card numbers on our systems. By placing an order you authorize the charge to your payment method.
- Receipts. A receipt is emailed to you on successful payment.
- Taxes. Florida sales tax is not currently applied to our facilitation services based on our working analysis that they are professional services. If a tax authority later determines tax applies, we will collect and remit as required by law.
- Failed or disputed payments. If your payment fails or is reversed, we may suspend processing and close the order.

7. Document Submission and Customer Warranties
- You agree to submit documents only through the secure HTTPS upload channel provided on the Site. We do not accept passports or government-ID submissions by email or messaging platforms.
- You warrant that all documents and information you submit are genuine, current, accurate, and lawfully obtained.
- Submission of forged, altered, or fraudulent documents is prohibited, results in immediate termination of your order without refund, and may be reported to the IRS, law enforcement, and our CAA Partner.

8. Processing Timeline and No Guarantee of Approval
- Atlas + CAA preparation and submission: Standard 7 to 10 business days; Priority 1 to 3 business days, in each case from the date we receive and verify all required documents.
- IRS processing: approximately 6 to 12 weeks from submission. Processing time is outside our control and may be longer during U.S. tax season (January through April) or for overseas applicants, consistent with IRS published guidance.
- No guarantee of approval. ITIN approval is at the sole discretion of the IRS. We do not, and cannot, guarantee that any application will be approved.
- Status updates. We provide milestone updates by email and, if you have opted in, by SMS or WhatsApp.
9. What an ITIN Does Not Do
An ITIN is a tax processing number issued by the IRS for U.S. federal tax filing purposes only. An ITIN does not:
- Authorize employment in the United States;
- Provide immigration status or legal residency;
- Confer eligibility for Social Security benefits;
- Guarantee tax refunds, stimulus eligibility, credit, bank accounts, loans, or any other financial product or government benefit;
- Replace a Social Security Number (SSN) for any purpose for which an SSN is required.

10. Document Return and Destruction
We accept only photographs and digital scans of identity documents. We do not receive original passports or original government IDs by mail. Uploaded documents are retained per the schedule in our Privacy Policy and our Document Handling and Data Security Statement, then securely destroyed.
11. Communications Consent
- Transactional email. By placing an order you consent to receive transactional email from us about your order, including status updates and required notices. Transactional email is not subject to the marketing opt-out.
- Marketing email. Marketing email is sent only if you opt in. You may opt out at any time by clicking the unsubscribe link in any marketing email or by replying UNSUBSCRIBE. Our CAN-SPAM postal address is Atlas Compliance Inc, 2125 Biscayne Boulevard, Ste 204 #24685, Miami, Florida 33137, USA.
- SMS and WhatsApp express written consent. If you provide your mobile number and tick the SMS or WhatsApp consent box, you give express written consent under the Telephone Consumer Protection Act, 47 U.S.C. §227, and Florida's Telephone Solicitation Act, Fla. Stat. §501.059, to receive transactional and marketing SMS and WhatsApp messages from us or our messaging vendor (Klaviyo for SMS; Meta WhatsApp Business API for WhatsApp). Message frequency varies, with up to approximately ten messages per month per channel.
- Standard message and data rates may apply. Carrier charges are not within our control.
- Opt-out. Reply STOP to any marketing SMS or WhatsApp message to opt out. Reply HELP for help. You may also email hello@atlas-itin.com to revoke consent. Transactional messages relating to an active order may continue after a marketing opt-out.
- Consent is not a condition of purchase. We will not deny our Service if you decline marketing consent.
12. Intellectual Property
- We own all rights, title, and interest in the Site, our trademarks, logos, and content, except for content you submit and any third-party marks.
- You retain ownership of the documents you submit. By submitting documents you grant Atlas and the CAA Partner a limited, non-exclusive, revocable license to use, copy, transmit, store, and process those documents solely for the purpose of facilitating your ITIN application.
- You may not reproduce, redistribute, scrape, or reverse-engineer the Site or any part of the Service.
13. Acceptable Use
Use of the Service is also subject to our Acceptable Use Policy, incorporated here by reference.
14. Privacy
Your privacy is governed by our Privacy Policy, incorporated here by reference.
15. State Tax-Preparer Licensing Notice (California and Oregon)
Atlas is not a California Tax Education Council (CTEC)–registered tax preparer under California Business & Professions Code §22251 et seq. Atlas is not a tax preparer licensed by the Oregon Board of Tax Practitioners under ORS 673.605–673.740. Atlas provides ITIN application facilitation services only and does not prepare or sign U.S. federal or state tax returns. Atlas does not give tax, legal, or immigration advice. Customers seeking such advice should consult a qualified, independently licensed professional. California and Oregon residents may contact their respective regulators with any questions about tax-preparer licensing.
16. Refunds and Cancellations
Refunds and cancellations are governed by our Refund and Cancellation Policy, incorporated here by reference.
17. Customer Support, SLA, and Escalation
- Hours. Monday through Friday, 9:00 AM to 6:00 PM Eastern Time, excluding U.S. federal holidays.
- Channels. Email at hello@atlas-itin.com; outbound SMS and WhatsApp where you have opted in.
- Languages. English, Spanish, and Portuguese.
- Response SLA. We respond to email inquiries within one business day.
- Escalation. If you are dissatisfied with a response, reply to the existing support thread and include the words "request escalation." Escalated cases are reviewed by a manager within two business days.
18. Force Majeure
We are not liable for delays or failures caused by events outside our reasonable control, including IRS processing delays, government shutdowns, postal-carrier disruptions, internet or cloud-provider outages, natural disasters, labor disputes, war, terrorism, civil unrest, pandemics, or changes in law.
19. Indemnification by Customer
You agree to indemnify, defend, and hold harmless Atlas, our CAA Partner, and our and their respective officers, directors, employees, and agents from any third-party claim arising out of or related to: (a) your misrepresentation, breach of warranty, or fraud in connection with your order; (b) your submission of documents you do not have the right to submit; (c) your violation of these Terms or applicable law.
20. Disclaimer of Warranties
To the maximum extent permitted by law, the Service and the Site are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or result in a particular outcome. Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions only the exclusions permitted by law apply.
21. Limitation of Liability
To the maximum extent permitted by law, our total liability arising out of or related to the Service is limited to the fees you paid for the order at issue. We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, or loss of goodwill, even if we have been advised of the possibility of such damages. Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including the Florida Deceptive and Unfair Trade Practices Act, Fla. Stat. §501.201 et seq., and any non-waivable consumer-protection right.
22. Governing Law
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-laws rules. The Federal Arbitration Act, 9 U.S.C. §§1–16, governs the interpretation and enforcement of Section 23.
23. Dispute Resolution — Mandatory Individual Arbitration, Class-Action Waiver, and Opt-Out
Please read this Section carefully. It affects how disputes between you and Atlas are resolved.
23.1 Plain-language summary
You and Atlas agree that most disputes will be resolved by binding individual arbitration rather than in court. You waive the right to bring or participate in a class, collective, or representative action. You may opt out of this arbitration agreement within 30 days of accepting these Terms by following Section 23.7. Small-claims actions may proceed in small-claims court. California residents retain the right to seek public injunctive relief in court.
23.2 Informal dispute resolution (60-day window)
Before initiating arbitration, you and we agree to attempt in good faith to resolve any dispute informally for at least 60 days after the claimant sends a written notice describing the dispute and the requested relief. Customer notices must be sent to hello@atlas-itin.com and to the postal address in Section 28. Atlas notices will be sent to the email and postal address you provided in your order.
23.3 Agreement to arbitrate
Except as set out in Sections 23.5 and 23.6, any dispute, claim, or controversy between you and Atlas arising out of or related to the Service, the Site, these Terms, marketing, or your data will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules in effect at the time the demand is filed, available at adr.org. The arbitrator, and not any court, has exclusive authority to resolve any dispute about the formation, scope, applicability, enforceability, or waiver of this arbitration agreement.
23.4 Class-action waiver
You and we agree that each may bring claims against the other only on an individual basis, not as a plaintiff or class member in any purported class, collective, consolidated, mass, or representative action. The arbitrator may not consolidate claims of more than one person and may not preside over any form of representative or class proceeding. If a court decides that applicable law precludes enforcement of any part of this waiver as to a particular claim for relief, that claim (and only that claim) shall be severed from the arbitration and brought in the courts identified in Section 23.8.
23.5 Small-claims carve-out
Either party may bring a claim in small-claims court in Miami-Dade County, Florida, or in the small-claims court of the state and county where you reside, if the claim qualifies for small-claims jurisdiction in that court.
23.6 Public-injunctive-relief preservation (McGill carve-out)
If you reside in California, the parties agree that any claim seeking public injunctive relief is severed from this arbitration agreement and may be litigated in the courts identified in Section 23.8 after arbitration of all other claims is complete.
23.7 30-day opt-out right
You may opt out of this arbitration agreement (including the class-action waiver) by sending written notice within 30 days of first accepting these Terms. Your notice must include your full name, the email address you used to place your order, your mailing address, the order number (if any), and a clear statement that you opt out of arbitration. Send the notice to:

Opting out does not affect any other provision of these Terms. If you opt out, disputes will be resolved in the courts identified in Section 23.8.
23.8 Forum for claims not subject to arbitration
For any claim that is not subject to arbitration under this Section 23, you and we submit to the exclusive jurisdiction of the state and federal courts located in Miami-Dade County, Florida. Each party waives any objection to venue or to personal jurisdiction in those courts.
23.9 Arbitration location, fees, and rules
Arbitration will be seated in Miami-Dade County, Florida. The arbitrator may, at your election under AAA Consumer Rules, conduct any hearing by telephone or video. Atlas will pay the AAA fees specified in the AAA Consumer Arbitration Rules. Each party bears its own attorneys' fees and costs unless the arbitrator awards otherwise under applicable law. Atlas will register this arbitration agreement with the AAA Consumer Clause Registry as required by AAA rules.
23.10 Severability
If any portion of this Section 23 is found unenforceable, that portion shall be severed; the remainder remains in effect. If the class-action waiver is found unenforceable as to a particular claim, that claim shall proceed in court under Section 23.8 and all other claims shall continue in arbitration.
24. Changes to the Service and to These Terms
We may modify the Service and these Terms from time to time. The "Last updated" date at the top of these Terms reflects the most recent change. For changes that materially adversely affect your rights, we will provide reasonable advance notice (for example, by email or a banner on the Site) and, where required by law, obtain your affirmative consent before the change applies to you.
25. Termination
We may suspend or terminate your access to the Service for breach of these Terms, suspected fraud, or unlawful conduct. Termination does not waive any accrued rights or obligations.
26. Severability, Waiver, Entire Agreement, Assignment, No Third-Party Beneficiaries
- If any provision of these Terms is held unenforceable, the remaining provisions remain in force.
- Our failure to enforce a right is not a waiver.
- These Terms, together with the policies they incorporate by reference, are the entire agreement between you and us regarding the Service.
- You may not assign these Terms without our written consent. We may assign these Terms to a successor in interest in a merger, acquisition, or asset sale.
- There are no third-party beneficiaries to these Terms.
27. Electronic Communications and E-Sign Act
By using the Service you consent to receive communications and disclosures from us in electronic form, including by email, SMS, WhatsApp, and through the Site. Your electronic acceptance of these Terms has the same legal effect as a handwritten signature under the Electronic Signatures in Global and National Commerce Act, 15 U.S.C. §7001. You may request a paper copy of any electronic disclosure by emailing hello@atlas-itin.com.
