Refund and Cancellation Policy
Refund and Cancellation Policy
Important. Atlas Compliance Inc is a private service facilitation company registered in the State of Florida, USA. We are not a Certifying Acceptance Agent (CAA), not a government agency, and not affiliated with, endorsed by, or associated with the Internal Revenue Service (IRS). ITIN applications submitted through our platform are processed, certified, and submitted to the IRS by IRS-authorized Certifying Acceptance Agents through our business partnerships. ITIN approval is determined solely by the IRS — we cannot guarantee approval of any application. An Individual Taxpayer Identification Number (ITIN) is issued by the IRS for federal tax filing purposes only. It does not authorize employment in the United States, does not provide immigration status or legal residency, and does not confer eligibility for Social Security benefits.
This Refund and Cancellation Policy explains when, how, and to what extent you can cancel an order and obtain a refund. It applies to every customer of Atlas worldwide as a single universal rule. Where local consumer-protection law gives you stronger rights, those rights apply (see Section 8).

1. Plain-English Summary
- You can cancel and request a refund within 14 days of placing your order, provided we have not yet sent your application to our IRS-authorized CAA partner. We deduct a 5% processing fee to cover non-refundable payment-processor costs.
- Once your application has been submitted to our CAA partner and then to the IRS, the application cannot be unilaterally withdrawn and refunds are no longer available.
- If the IRS rejects the application because of a CAA error, our CAA partner corrects and resubmits at no additional charge to you.
- If the IRS rejects because of incorrect or missing information you provided, we will work with you on a goodwill basis to resubmit, but we do not provide a refund.
- IRS processing time is approximately 6 to 12 weeks and is outside our control. Delays beyond 12 weeks do not entitle you to a refund.
The full milestone matrix is in Section 3 below.
2. How Our Service Works (Why the Milestones Matter)
Your order moves through three custody zones:
- Atlas custody. We receive your order, collect documents, and verify completeness.
- CAA partner custody. We hand the verified application package to an IRS-authorized Certifying Acceptance Agent (CAA) partner, who reviews, certifies, and submits the application to the IRS.
- IRS custody. The IRS receives, reviews, and makes the final determination.
Refund availability depends on the zone your order is in when you cancel. This is a "service facilitation" business model — once the CAA partner performs work and the application leaves our hands for the IRS, the fees for that work have been incurred.
Tier-timeline disclaimer. The 7–10-business-day Standard tier timeline and the 1–3-business-day Priority tier timeline cover Atlas and CAA preparation and submission to the IRS only. They do not include IRS processing. IRS processing takes approximately 6 to 12 weeks after submission and is outside our control.
3. Refund Milestone Matrix (Universal Rule)
| Stage | Refund | Window |
|---|---|---|
| Order placed; no documents uploaded yet | Full refund minus a 5% processing fee | Within 14 days of order |
| Documents uploaded; we have not yet sent the application to the CAA partner | Full refund minus a 5% processing fee | Within 14 days of order |
| Application sent to the CAA partner and submitted to the IRS | No refund — work has been performed by the CAA partner and the application is in IRS hands. We will, in good faith, work with you if the IRS rejects the application because of a CAA error (see next row). | — |
| IRS rejects the application because of a CAA error | No refund. Per our partnership agreement, the CAA partner corrects and resubmits the application at no additional charge to you. | — |
| IRS rejects the application because of incorrect, incomplete, or missing information you provided | No refund. On a goodwill basis we will work with you to identify the deficiency and resubmit. You remain responsible for providing any additional documentation requested. | — |
| IRS rejects the application based on IRS discretion or for other reasons outside our control | No refund. We will provide a written explanation and any IRS correspondence we receive. | — |
| You do not respond to our documentation requests within 60 days of placing the order | No refund. The order is closed for abandonment. | 60-day abandonment window |
| ITIN has been issued and delivered to you | No refund — the service has been fully delivered. | — |
The 5% processing fee covers our non-refundable payment-processor costs (Stripe charges approximately 2.9% plus $0.30 per transaction, which is not returned to us when we issue a refund) plus a small administrative margin.
4. How to Cancel and Request a Refund
Send an email to hello@atlas-itin.com with the following information:
- Subject line: "Refund Request — [your order number]"
- The full name and email used to place the order
- The order number
- A brief description of your reason for cancellation
We will confirm receipt within one business day and, where a refund is due under this Policy, approve it within five business days of having sufficient information to process the request. Refunds are returned to the original payment method.
5. Refund Timing
Approved refunds are issued to the original payment method, typically within 5 to 10 business days of approval. The timing for the refund to appear on your statement depends on your card issuer or bank.
6. Chargebacks
If you initiate a chargeback or payment dispute with your card issuer instead of, or after, requesting a refund through us:
- We will cooperate with Stripe's dispute process and provide documentation of service delivery, your order details, and your acceptance of these Terms.
- If a chargeback is filed for an order in which substantial work has already been performed by the CAA partner, we may treat the chargeback as a material breach of these Terms and pursue recovery, including referral to collections where lawful.
- If a chargeback is filed in bad faith for documented fraud purposes, we may report the conduct to law enforcement.
7. Not a Subscription; No Auto-Renewal
Our Service is a one-time facilitation service. We do not operate a subscription. There is no automatic renewal of any kind. The Florida Automatic Renewal of Service Contracts statute, Fla. Stat. §501.165, does not apply because no auto-renewal exists.
8. Statutory Rights Preserved (Most-Generous-Rights Rule)
Nothing in this Policy limits or replaces any right you have under applicable consumer-protection law that is more generous than this Policy. In particular:
- United States — Federal Trade Commission Act §5 and Florida Deceptive and Unfair Trade Practices Act (Fla. Stat. §501.201 et seq.). Our refund commitments do not waive the deceptive-practices framework provided by these laws.
- California — Consumers Legal Remedies Act (Cal. Civ. Code §1750 et seq.). California residents retain all non-waivable rights under the CLRA.
- European Union — Consumer Rights Directive (Directive 2011/83/EU). EU consumers may exercise the 14-day right of withdrawal where it applies under that Directive. By starting the service before the end of the 14-day period (for example, by uploading documents) you may lose the right of withdrawal under Article 16 of the CRD for services fully performed at your express prior request.
- United Kingdom — Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. UK consumers retain the 14-day cancellation right where it applies, subject to the same "service started" qualification.
- Brazil — Código de Defesa do Consumidor, Lei nº 8.078/1990, Art. 49. Brazilian consumers retain the 7-day right of withdrawal where it applies to distance contracts.
To exercise any of these rights, email hello@atlas-itin.com and identify the statute or directive on which you rely. We will not charge or penalize you for exercising a statutory right.
9. No Guarantee of ITIN Approval
ITIN approval is at the sole discretion of the IRS. We do not, and cannot, guarantee approval of any application. IRS processing is approximately 6 to 12 weeks and is outside our control. Delays beyond 12 weeks do not entitle you to a refund.
